1. OVERVIEW

This website is operated by The Trading Floor. Throughout the site, the terms “we”, “us” and “our” refer to The Trading Floor. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing a trading desk from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

2. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or state of residence. Our products, specifically high-performance trading desks, are intended for professional and personal use in an office or home office environment. You may not use our products for any illegal or unauthorized purpose.

3. ACCURACY OF PRODUCT INFORMATION

We specialize in specialized furniture for active traders (day traders). While we strive to display our products as accurately as possible:

Display: We cannot guarantee that your computer monitor’s display of any color will be accurate.

Assembly: Unless otherwise stated, desks are delivered unassembled.

Load capacity: It is the user’s responsibility to comply with the specified weight limits for each model in order to ensure the structural integrity of the product.

4. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. In accordance with Québec law, the price displayed at the time of purchase is the price that will be honored, except in the case of an obvious typographical error. We reserve the right to modify or discontinue the Service at any time.

5. BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

Taxes: Sales taxes (GST and QST) will be applied based on the delivery destination within Canada.

6. SHIPPING AND DELIVERY

Delivery dates are estimates and are not guaranteed. The risk of loss and title to the goods pass to you upon delivery of the merchandise to the carrier.

Inspection: Upon delivery, you must inspect the packaging for any signs of damage before signing the carrier’s delivery receipt.

7. RETURNS, REFUNDS AND EXCHANGES

Your purchase is subject to our Return Policy, which provides a 30-day period for unused items in their original packaging. Please consult our full policy to learn how to initiate a return by contacting: legal@thetradingfloor.io.

8. LEGAL WARRANTY (QUÉBEC RESIDENTS)

The Consumer Protection Act provides a legal warranty on the goods you purchase. The goods must be:

  • fit for the purposes for which they are ordinarily used; and

  • durable for a reasonable period of time, having regard to their price and the conditions of use.

The Trading Floor acknowledges these legal warranties, which apply notwithstanding any contractual clause to the contrary.

9. LIMITATION OF LIABILITY

To the extent permitted by law, The Trading Floor shall not be liable for any direct, indirect, incidental or punitive damages arising from the use of our products.

Note: In Québec, liability for bodily or moral injury, or resulting from gross or intentional fault, cannot be excluded. This clause applies to the fullest extent permitted by the Civil Code of Québec.

10. INTELLECTUAL PROPERTY

All content on this site, including text, graphics, logos and images, is the property of The Trading Floor and is protected by Canadian and international copyright laws.

11. GOVERNING LAW AND JURISDICTION

These Terms of Service are governed by and construed in accordance with the laws of the Province of Québec and the laws of Canada applicable therein. Any dispute arising herefrom shall be brought before the courts of the judicial district of Québec, to the exclusion of any other jurisdiction.

12. LANGUAGE PROVISION

The parties confirm their intention that these terms be drafted in French.

(Note: Pursuant to Bill 96, the French version must be made available to Québec customers.)
